Terms of Service

Welcome to LullabyGlow. These Terms of Service ("Terms") govern your use of the LullabyGlow mobile application and website at lullabyglow.com (collectively, the "Service"), operated by LullabyGlow ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account and use the Service. By using the Service, you represent that you are at least 18 years of age. The Service is designed for parents and family members to use for the benefit of their children.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Subscriptions & Payments

Free Tier: Basic features are available at no cost, subject to usage limitations.

Premium Subscriptions: Enhanced features, including AI Voice Clone, expanded storage, and Voice Time Capsules, require a paid subscription. Subscription pricing is displayed in the app and may vary by region.

Billing: Subscriptions purchased through the iOS App Store are billed through Apple and subject to Apple's terms. Subscriptions purchased through our website are processed via our third-party payment processor.

Cancellation: You may cancel your subscription at any time. For App Store purchases, manage your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

Refunds: Refund requests for App Store purchases are handled by Apple per their refund policy. For web purchases, contact support@lullabyglow.com within 14 days of purchase.

4. Your Content

Ownership: You retain all ownership rights to the voice recordings, messages, and other content you create using the Service ("Your Content"). We do not claim ownership of Your Content.

License to Us: By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the Service to you. This includes processing for AI voice enhancement and voice cloning features you choose to use.

Responsibility: You are solely responsible for Your Content. You agree that you have the right to share any content you upload and that your content does not violate any third party's rights.

5. Family Sharing & Lullaby Circle

The Service allows you to share voice recordings with family members through the Lullaby Circle feature. When you invite someone to your Lullaby Circle, you are granting them access to listen to shared recordings. You are responsible for managing who has access to your Lullaby Circle. We recommend only inviting trusted family members.

6. Voice Time Capsules

Voice Time Capsules allow you to seal voice recordings that unlock on a future date. By creating a Time Capsule, you acknowledge that the recording will be stored until the designated unlock date. Early deletion is available through your account settings. We will make commercially reasonable efforts to preserve Time Capsules for their full duration, but cannot guarantee indefinite storage.

7. AI Features

AI Voice Enhancement: Our AI processes recordings to reduce noise and improve quality. Results may vary and we do not guarantee specific outcomes.

AI Voice Clone: This feature creates a personalized voice model based on your recordings. You acknowledge that AI-generated audio may not perfectly replicate your voice. You agree not to use AI-generated content for impersonation, fraud, or any unlawful purpose. Your voice model is personal to your account and is not shared with others.

9. Hardware (GlowOrb Device)

If you purchase a GlowOrb device, it is subject to a separate limited hardware warranty provided at the time of purchase. The device requires an active internet connection and a LullabyGlow account to function. Some features may require a premium subscription.

10. Intellectual Property

The Service, including its design, features, code, and branding, is owned by LullabyGlow and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will provide reasonable opportunity to export Your Content before deletion, except in cases of serious violations.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or secure. AI-generated content is provided for personal use and we make no guarantees regarding its accuracy or quality.

13. Limitation of Liability

To the fullest extent permitted by law, LullabyGlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, recordings, or voice models.

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law provisions.
